Terms of Service.

The ground rules for using Bhaksh — for the people rescuing meals and the kitchens offering them — written to India's consumer, e-commerce and food-safety law.

Please note. These terms are written to India's current framework and our company details are filled in, but they are not legal advice. We recommend a qualified Indian lawyer review the full document before you rely on it. Consumer rights under the Consumer Protection Act, 2019 cannot be contracted away — the perishable-food refund carve-out (section 8) and liability cap (section 14) especially warrant a lawyer's eye.
Applicable law. These terms are framed under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020; the Information Technology Act, 2000 (incl. intermediary safe-harbour under s.79) and the IT (Intermediary Guidelines) Rules, 2021; the Food Safety and Standards Act, 2006 (FSSAI); and the Indian Contract Act, 1872.

1. Who we are & acceptance

These Terms of Service ("Terms") govern your use of the Bhaksh Platform, operated by Growvior Software Private Limited, incorporated under the Companies Act, 2013 (CIN: U58200KL2025PTC095633), registered office 39/2475-B1, LR Towers, South Janatha Road, Palarivattom, Ernakulam - 682025, Kerala, GSTIN: not applicable (not currently GST-registered). By accessing or using the Platform you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. Nature of service — a marketplace intermediary

Bhaksh is a marketplace e-commerce entity and intermediary that provides a technology platform connecting customers with independent, FSSAI-registered restaurant partners who list surplus or unsold food. Bhaksh does not manufacture, prepare, cook, store, own or sell the food. The contract of sale for any item is directly between you and the restaurant partner, who is solely responsible for the quality, safety, hygiene, freshness, packaging, description and lawful sale of the food. Bhaksh acts only as a facilitator and gives no warranty regarding the food (Consumer Protection (E-Commerce) Rules, 2020, Rule 5; IT Act s.79).

3. Eligibility

You must be at least 18 years old and competent to contract under Indian law to create an account or place orders. By using the Platform you represent that you meet these requirements; the Platform is not directed at minors. Restaurant partners must be validly constituted businesses holding a valid FSSAI licence.

4. Your account

You register using mobile OTP and/or Google Sign-In. You must provide accurate, current information, keep your account credentials confidential, and are responsible for all activity under your account. Notify us promptly of any unauthorised use. Bhaksh operates a one-account-one-role model — separate accounts for customers and for restaurant partners. We may suspend or terminate accounts for breach, fraud or misuse.

5. Surplus-food listings, availability & pricing

Listings show surplus or unsold food offered at a discount. Because surplus quantities are limited and time-sensitive, availability is not guaranteed and a listing may sell out or expire between browsing and checkout. Prices are shown as a total price in a single figure inclusive of applicable taxes; any delivery charge is shown separately before you confirm. Restaurant partners are responsible for the accuracy of item descriptions, prices, portion sizes, allergen information and veg/non-veg markings. Bhaksh may correct obvious pricing errors.

6. Orders, reservation, pickup & delivery

Placing an order is an offer to purchase from the restaurant partner; a binding contract forms when the order is accepted or confirmed. For pickup orders, collect within the stated pickup window at the restaurant's address — food not collected in time may be forfeited without refund, at the restaurant's discretion. For delivery orders, estimated times are indicative. You are responsible for providing accurate pickup and delivery details. Surplus food should be consumed promptly and is sold on an as-is surplus basis.

7. Payments

Payments may be made in-app through our third-party gateway Razorpay, or on collection ("pay on pickup") where offered. Online payments are subject to Razorpay's terms; Bhaksh does not store your full card, UPI or banking credentials. Bhaksh is not liable for failures, delays or errors of the payment gateway or your bank, though we will help reconcile genuine issues. Prices are in Indian Rupees, and a valid tax invoice will be issued as applicable by Growvior Software Private Limited.

8. Cancellations, returns & refunds

Because surplus food is perishable and prepared for immediate consumption, orders once confirmed generally cannot be cancelled or returned, except:

  • where you cancel within 2 minutes of placing the order and before the restaurant begins preparation or handover; or
  • where the food is not made available, is materially not as described, is unsafe or spoiled, or the order is not fulfilled.

In these cases you are entitled to a refund. Approved refunds are processed to your original payment method within 5 to 7 business days via Razorpay. Raise a refund request through the app or with our Grievance Officer (section 17); Bhaksh will facilitate resolution between you and the restaurant partner. Nothing here limits your non-excludable rights under the Consumer Protection Act, 2019.

9. Restaurant-partner obligations

Each restaurant partner represents and warrants that it:

  • holds a valid FSSAI licence or registration (number displayed on its listing/profile) and complies with the Food Safety and Standards Act, 2006 and regulations;
  • ensures food is safe, hygienic, correctly described (including veg/non-veg symbol, allergens and mandatory declarations) and fit for consumption within the stated time;
  • does not make misleading claims or display misleading images; and
  • complies with the Consumer Protection Act, 2019 and E-Commerce Rules, 2020, including appointing its own grievance officer, acknowledging complaints within 48 hours, redressing them within one month, and not adopting unfair trade practices.

The restaurant partner — not Bhaksh — bears food-safety liability. Bhaksh may verify FSSAI/KYC details but does not independently guarantee them.

10. Food-safety disclaimer

Food sold on Bhaksh is surplus or unsold food offered by third-party, FSSAI-registered restaurants. Bhaksh displays the FSSAI licence information of listed restaurants but does not prepare, inspect or certify the food. Please check allergen and dietary information and consume the food promptly. Report any food-safety concern immediately to the restaurant and to our Grievance Officer (section 17).

11. User conduct & prohibited uses

You must not use the Platform to: post unlawful, defamatory, obscene, infringing, harmful or misleading content; impersonate any person; commit fraud, chargeback abuse, or misuse surplus/discount pricing for resale; scrape, hack, reverse-engineer or interfere with the Platform; post fake reviews; or violate any law, including food-safety and consumer-protection laws (IT Rules, 2021, Rule 3(1)(b)). Breach may result in content removal, account suspension or legal action.

12. Reviews, user content & intellectual property

Content and reviews you submit must be genuine and lawful; you grant Bhaksh a licence to display them, and we may moderate or remove content per our policy. The Bhaksh name, logo, app, software, design and content are owned by Growvior Software Private Limited and protected under Indian IP laws; no use is permitted without our written permission. Restaurant-partner trademarks belong to them.

13. Third-party services

The Platform relies on Google Sign-In, Razorpay, maps/geolocation and delivery providers, each governed by its own terms. Bhaksh is not responsible for the acts or omissions of these third parties.

14. Disclaimers & limitation of liability

The Platform is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Bhaksh disclaims all warranties regarding the food (which is the restaurant partner's responsibility) and continuous Platform availability. As a marketplace intermediary, Bhaksh is not liable for the quality, safety or fitness of food, for the acts or omissions of restaurant partners, delivery personnel or payment gateways, or for indirect, incidental or consequential losses. Where our liability is established, our aggregate liability for any claim shall not exceed the value of the specific order giving rise to the claim. This is read consistently with the non-excludable rights of consumers under the Consumer Protection Act, 2019.

15. Indemnity

You agree to indemnify and hold harmless Growvior Software Private Limited, its directors, officers and employees from any claim, damage or expense arising from your breach of these Terms, your violation of any law, or your misuse of the Platform. Restaurant partners additionally indemnify Bhaksh against food-safety and consumer claims arising from their food.

16. Term, suspension & termination

These Terms apply while you use the Platform. Either party may terminate; Bhaksh may suspend or terminate your access for breach, fraud or legal reasons. On termination you lose access to the Platform, but clauses that by their nature survive — including intellectual property, liability, indemnity and dispute resolution — continue to apply.

17. Grievance redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the IT (Intermediary Guidelines) Rules, 2021, our Grievance Officer is:

We will acknowledge complaints within 48 hours and endeavour to resolve them within one month (and, for content/IT-Rules grievances, acknowledge within 24 hours and resolve within 15 days). You may also escalate to the National Consumer Helpline (1915) or the consumer e-Daakhil portal.

18. Governing law & dispute resolution

These Terms are governed by the laws of India. Subject to the non-excludable rights of consumers to approach consumer forums under the Consumer Protection Act, 2019, the courts at Kochi shall have exclusive jurisdiction. The parties will first attempt to resolve any dispute amicably.

19. Changes to these terms

We may amend these Terms at any time. Material changes will be notified in-app or by email and the "Last updated" date revised. Continued use after changes constitutes acceptance.

20. Miscellaneous

If any provision is held invalid, the rest remain in force (severability). Our failure to enforce a right is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us on this subject. Bhaksh may assign these Terms; you may not. Neither party is liable for delay or failure caused by events beyond its reasonable control (force majeure). These Terms are provided in English, which prevails; other-language versions are for accessibility.
